Top Venting Compressor Rejected

My wife and I will be building a new home and our plans submitted to the zoning authorities for approval were rejected due to having a top venting compressor on the side of the home which has only 5' of clearance to the next property. The architect is baffled as similar plans have been approved with the present code but there is a new inspector who interprets the code as not permitting it. It's a problem as this is much the best side for us to place a compressor.

Is this likely a code issue due to noise or fire safety for us or for the neighbor? Or for another reason?

Planning on meeting the inspector and asking under what conditions she would permit having a compressor on this building side. I see there are horizontal venting compressors. Thought I could offer to use one or these venting away from our home or along the side of it, or offer to build enclosures or shield for a top venting unit.
