New evaporator coil installed without drip pan on horizontal unit

Had a evaporator coil fail and replaced on a Rheem (installed 2015)split system in October 2021 by a reputable company but didn't use the A/C much since cooler weather and winter. Warmer weather arrives and emergency drip pan keeps filling up. Unit completely shuts down so I called the installer and they said it would be a couple days before they can get to it. I call another company and they come and clean out the lines. Pan fills again, so knowing what the "problem" was I decide to remedy it myself and blow the lines out again. I opened up the evaporator case and discover there is no drip pan what so ever installed horizontally and condensation has no where to go but down on the insulation and to the emergency pan. I called the original installer to inform them of their royal screw up and they did send someone that day. The tech concurred and stated the installer must've just not noticed. I told him that the installer was in such a huge hurry that I wasn't surprised. He also didn't fully charge the system so they had to come back out to fix that too shortly after it was installed. The tech said a "new one" would be ordered and we could continue to use the A/C "at our own risk" but the emergency pan could fail since it's now rusted.

So now my emergency pan is completely rusted and surprisingly it is still holding water. I've pumped 10 gallons or so of water in order to keep the A/C going so my family doesn't roast. The emergency cut off is still working and I will pump water every day or so until they fix their screw up.

Should the installer be required to replace the emergency pan since it's now completely rusted and now prone for failure? The secondary pan was in like new condition until their fiasco. What other things are they liable for since their failure to adequately and properly install the right evaporator with a horizontal drip pan?
